This is Idiotic!!..but First an H1N1 Update

Yesterday the “final” report on the H1N1 vaccine was released with it’s recommendation for children. We have heard for months that more than one dose of the vaccine might be required to get full protection. Here are the guidelines: Children 10 to 17 years old need only one shot, children 6 months to 9 years old need two shots given 21 days apart. The U.S. government has ordered a total of 250 million doses of the vaccine, there are 450 million people in the United States. Those are the facts. NOW, I am about to rant a little. Have you heard the latest concerning garage sales? Yes the government has now established a guideline for the sale of used items. This is greatly impact thrift stores and garage sales which during these tough times provide the source of inexpensive, yet good, times for families who can not afford to buy new. They have also provided a source of a little extra income to many who are struggling. So much for the government caring about the poor.

In order to comply, stores, flea markets, charities and individuals selling used goods — in person or online — are expected to consult the commission’s 24-page Handbook for Resale Stores and Product Resellers (pdf) and its Web site for a breakdown of what they can’t sell.

Violators caught selling anything on the enormous list face fines of up to $100,000 per infraction and up to $15 million for a related series of infractions.

Though the CPSC says it won’t be sending enforcers to garage sales or yard sales, FOX News Legal Analyst Bob Massi says the law makes no distinction for families and small resellers.

“The overall law I think is awfully broad and doesn’t take all of the science into effect,” he told FOXNews.com. “You can’t consume lead by touching something and putting your finger in your mouth. That’s not how it happens. The lead has to be injested and has to be injested in particles small enough to enter the bloodstream or on a material in the stomach where it will be digested in the stomach acids and go into the bloodstream — and that’s never happened from toys.”

“If I’ve got a wirebound notebook, the lead content in that wire binding is now under scrutiny, even though the chance of ingesting lead in any amount from something like that is virtually non-existent,” he said. “It’s a level of political grandstanding to say ‘we’re taking care of everything,’ but the science clearly demonstrates that the transference is not really possible — I mean, a child who eats the wire binding from a notebook is going to have significantly worse health problems than lead.”

“Many children have choked and died on small parts that have broken off or been incorporated into toys,” Wolfson told FOXNews.com.

Great…so now if a child chokes on something bought at a yard sale the parents can sue? How are families who are struggling to make ends meet supposed to feed their family when they can not even hold a garage sale? Rely on government program? Done ranting…I just get so frustrated with politicians who run on platforms that they say are to help and protect the poor, and those who opposed government regulations are the enemy of the poor, and then they do this…

    Amen! Keep on ranting! The gov’t does some really stupid things, and this garage sale law is one of them. It’s so annonying!

  2. Is this part of Consumer Product Safety Improvement Act (CPSIA)? Because if so… it doesn’t just affect people holding garage sales and thrift shops. It also is going to have a major impact on small businesses (crafters) who make and sell handmade goods for children under 12. There was a stay of implementation until Feb 10, 2010, but after that, small crafters may have to have any of their products intended for children to be tested. The cost of such testing would be prohibitive and would force many of them out of business.

    That poorly written piece of legislation that was supposed to be designed to prevent large companies from importing toys, etc containing lead from places like China. Instead it could very well put many small business people (many of them women) out of business at a time when they are struggling just to make ends meet.

    No, not the same act. That is the frustration. So much regulation that it forces us to become dependent on the government. What happened to personal responsibility? As a parent shouldn’t I be responsible for the purchase of items at a garage sale or thrift shop? I can understand testing for lead on imports but once something is in the country it has been tested, right? So why should further testing be necessary when a crafter assembles a project. It is all so far out of control! All of this together with bail outs and ACORN type handouts are really beginning to create a backlash, as we have seen with all the tea parties, and I for one am glad people are finally asking questions.
